1. Acceptance of Terms
By accessing the website and subscribing to the services offered by Pen and Key LLC, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.
2. Description of Service
Pen and Key LLC provides legal news, summaries of newly released decisions by the Michigan Supreme Court and the Michigan Court of Appeals, legislative updates, and other relevant criminal justice news. These summaries are delivered digitally to incarcerated individuals within the Michigan Department of Corrections (MDOC) via third-party institutional messaging systems.
The estimates of the number of case summaries and news summaries and the number of JPays that will be sent to each subscriber for each tier of service per month are only estimates. The actual numbers depend on the number of court decisions issued and the number of news articles released regarding the relevant subjects.
3. Delivery Disclaimer & Limitation of Liability
Delivery of the news summaries and materials provided by Pen and Key LLC is strictly dependent on the State of Michigan, the Michigan Department of Corrections, and third-party communications providers (including, but not limited to, JPay.com).
Pen and Key LLC has no control over the operations, policies, technical outages, or disciplinary restrictions imposed by these entities. In the event that actions taken by the State of Michigan, institutional facilities, or third-party providers delay, reject, or completely prevent the delivery of our news summaries to the designated subscriber, the purchaser agrees that Pen and Key LLC is not liable for such non-delivery.
All sales are final and non-refundable.
4. Payment and Billing
Subscriptions are billed either monthly or annually, as selected at the time of purchase. Payments are processed securely through third-party payment gateways. Because of the digital nature of the services and the third-party dependencies outlined in Section 3, we do not offer refunds or prorated refunds for canceled subscriptions or undelivered materials.
5. Accuracy of Information
It is the sole responsibility of the purchaser to ensure that the prisoner's name and MDOC number are accurate. Pen and Key LLC is not responsible for failed deliveries resulting from incorrect identifying information provided at the time of subscription.
6. Not Legal Advice
The summaries and materials provided by Pen and Key LLC are for informational and educational purposes only. They do not constitute legal advice, nor does the provision of these materials create an attorney-client relationship. Subscribers and purchasers should consult with a qualified attorney for legal representation or advice regarding specific cases. Pen and Key LLC is an independent informational and paralegal staffing corporation. It is not a law firm, and neither Patrick Kinney nor any other employee, agent, or contractor of Pen and Key LLC is an attorney.
